Can a tow truck driver tow a vehicle at their discretion?

Yes, but only in limited circumstances.  Generally speaking a driver may tow a vehicle at their discretion from any of the four areas to include fire lanes, handicap, fire hydrant and egress.  There must be a written authorization between the Tow-Operator and the property owner along with the required signage. Is the Tow-Operator required to disclose who requested my vehicle be towed.  No, for safety concerns the Tow-Operator by law can not disclose specific information regarding the individual who requested the tow.  However, if you request a copy of the signed specific request for the tow, the Tow-Operator must provide this to you if applicable but with specific information redacted.  For a complete overview of the statutes, see link for actual law. Note: a signed specific request is not required in all instances.  For immediate tow situations there must be a written authorization (agreement) in effect.
Is the Tow-Operator required to show me photographs?  Not for all tows.  Photographs are only required when your vehicle was towed from a fire lane, fire hydrant area, handicap area or egress area. You must request to see the photographs.  See link for actual law.
